1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Brain Rest Chrome extension ("Extension," "Service," "we," "us," or "our"). By installing, accessing, or using the Extension, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Extension.

The Extension is operated by Brain Rest, an independent (solo) developer. There is no registered company name. You can reach us at support@brainrest.pro. For paid subscriptions, purchases are sold and processed by Polar (polar.sh), which acts as the Merchant of Record (see Section 4).

The Extension is provided as a productivity tool for tracking website screen time and promoting healthy browsing habits. These Terms apply to all users of the Extension, including those on the free plan and those who purchase Brain Rest Pro.

2. Description of Service

Brain Rest is a Chrome browser extension that provides the following features:

• Automatic tracking of time spent on websites
• Display of daily, weekly, and monthly usage statistics
• Setting of daily time limits for specific websites
• Optional website blocking when limits are reached
• Break reminders and notifications
• Data export capabilities in JSON and CSV formats
• Optional cloud synchronization through Supabase (when enabled)
• Visual analytics and reporting of browsing patterns

The Extension operates primarily with local data storage on your device. Cloud features are optional and require explicit user activation.

3. Plans (Free & Pro)

Brain Rest is offered on a freemium basis. The free plan is available at no cost and includes:

• Up to 7 days of usage history
• Up to 3 enforced blocked sites
• Up to 3 categories
• The Pomodoro Classic preset
• A warning action when a daily limit is reached
• JSON data export
• Brain levels and recent-activity analytics
• Break mode

Brain Rest Pro is a paid upgrade that unlocks the following:

• Full usage history beyond 7 days
• Calendar analytics
• "Block" and "Redirect" enforcement actions when a daily limit is reached (in addition to the warning action)
• Unlimited blocked sites
• Unlimited categories
• Custom Pomodoro presets

We may add, change, or remove features within the free and Pro plans over time. The specific features available to you depend on the plan you are on at any given time.

4. Subscriptions & Billing

4.1 Pricing

Brain Rest Pro is available on the following plans:

• Monthly: US $4.99 per month
• Annual: US $29 per year
• Lifetime: US $69, one-time payment

Prices are stated in U.S. dollars and may change from time to time. We will give you notice of any price change before it applies to you, and any change will take effect no earlier than your next billing period.

4.2 Auto-renewal

The Monthly and Annual plans are recurring subscriptions. They renew automatically at the end of each billing period (monthly or yearly, respectively) at the then-current price, and your payment method is charged automatically, until you cancel. The Lifetime plan is a single, one-time purchase; it does not recur and is not charged again.

4.3 Payment processor and Merchant of Record

Payments are processed by Polar (polar.sh), which acts as the Merchant of Record for all purchases of Brain Rest Pro. Checkout takes place on a Polar-hosted page. When you purchase a subscription, your purchase is also subject to Polar's terms of service and privacy policy, available at https://polar.sh/legal. Polar handles payment collection, billing, applicable taxes, and any legally-required refunds.

4.4 Cancellation

You can cancel a recurring subscription at any time through the Polar customer portal at https://polar.sh/brainrest/portal. When you cancel a recurring plan, you will not be charged again, and your Pro access continues until the end of the current billing period, after which your account reverts to the free plan.

4.5 Refunds

Except where required by applicable law, all payments are final and non-refundable, and we do not provide refunds or credits for partial billing periods or unused time. Where a refund is required by applicable law, it is processed by Polar as the Merchant of Record.

5. Eligibility

You must be at least 13 years of age to use the Extension. By using the Extension, you represent and warrant that you meet this eligibility requirement. If you are using the Extension on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

6. User Accounts

Basic local time tracking can be used without an account, but an account is required to use the Extension's tracking and sync features. If you create an account:

• You must provide valid email credentials
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Cross-device synchronization is available to all signed-in users. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

7. Acceptable Use

You agree to use the Extension only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to reverse engineer, decompile, or disassemble the Extension
• Modify, adapt, or hack the Extension
• Use the Extension to track or monitor other users without their consent
• Use the Extension in any way that could damage, disable, or impair the Service
• Attempt to gain unauthorized access to any portion of the Extension or its related systems
• Resell, redistribute, sublicense, or otherwise commercially exploit the Extension itself without our express written consent
• Violate any applicable laws or regulations while using the Extension

For the avoidance of doubt, you may use Brain Rest for your own productivity, including in a work or business setting; the restriction above applies only to reselling or redistributing the Extension itself.

8. Chrome Permissions

The Extension requires certain permissions to function properly. By installing the Extension, you grant us permission to:

• Storage: Store your browsing time data and settings
• Tabs: Access tab information to track active websites
• Idle: Detect when you are away from your computer
• Alarms: Schedule periodic tasks and reminders
• History: Analyze your browsing history for reporting (when enabled)
• Web Navigation: Track page transitions for accurate time tracking
• Host Permissions: Inject content scripts for activity detection

Optional permissions (requested only when features are enabled):

• Notifications: Send break reminders and limit alerts
• Context Menus: Add right-click menu options

9. Data Storage and Privacy

Your browsing data is stored locally on your device by default using Chrome's storage API. We do not have access to this local data unless you explicitly enable cloud synchronization. For detailed information about data collection and privacy practices, please refer to our Privacy Policy.

When cloud sync is enabled, data is transmitted and stored using Supabase infrastructure with appropriate encryption. You maintain ownership of your data and can export or delete it at any time.

10. Intellectual Property Rights

The Extension and its original content, features, and functionality are owned by Brain Rest and are protected by international copyright, trademark, and other intellectual property laws. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to install and use the Extension, including any Pro features you have purchased. This license covers both free and paid use. It does not permit you to resell, redistribute, sublicense, or otherwise make the Extension itself available to others.

You retain ownership of any data you generate through use of the Extension. By using cloud synchronization features, you grant us a limited license to store and process your data solely for the purpose of providing the Service.

11. Third-Party Services

The Extension integrates with the following third-party services:

• Supabase: Account authentication, cloud storage, and cross-device synchronization
• Polar: Payment processing and Merchant of Record for Brain Rest Pro purchases. See Polar's terms and privacy policy at https://polar.sh/legal
• Google Favicon Service: Display of website icons

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy practices, or services provided by third parties. For details on how we and our processors handle your data, see our Privacy Policy.

12. Disclaimers and Limitations

We do not warrant that:

• The Extension will function uninterrupted, secure, or error-free
• The tracking data will be 100% accurate at all times
• Any errors or defects will be corrected
• The Extension will be compatible with all websites or browser versions

The Extension is a productivity tool and should not be relied upon as the sole method for monitoring internet usage, particularly for parental control or employee monitoring purposes.

13. Limitation of Liability

Our total liability to you for any damages arising from your use of the Extension shall not exceed the greater of the amount you paid us in the prior twelve months or the total amount you have paid us for the Extension, up to a maximum of US $100.

14. Indemnification

You agree to indemnify, defend, and hold harmless Brain Rest and its developers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Extension
• Your violation of these Terms
• Your violation of any third party rights
• Any harm caused to other users or third parties through your use of the Extension

15. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Extension or by other means. Your continued use of the Extension after such modifications constitutes your acceptance of the updated Terms.

It is your responsibility to review these Terms periodically. The "Effective Date" at the top of this document indicates when these Terms were last updated.

16. Termination

You may stop using the Extension at any time by uninstalling it from your browser. We may suspend or terminate your access to the Extension or cloud features if you breach these Terms or for any other reason at our discretion.

Upon termination:

• Your right to use the Extension will immediately cease
• Local data will remain on your device unless you explicitly delete it
• Cloud data may be deleted after a reasonable retention period

If you have a paid plan, termination does not entitle you to a refund of any prepaid fees except where required by applicable law. If you cancel a recurring plan, your access ends in accordance with the cancellation terms in Section 4 (access continues until the end of the current billing period). If we terminate your paid access for a reason other than your breach of these Terms, any refund owed will be handled by Polar where required by applicable law.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Extension shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in Vietnam.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Brain Rest regarding the use of the Extension.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights under these Terms without restriction.
